JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-03-2023 The present writ petition has been filed seeking the following relief:- "That this application is preferred for issuance of a writ of mandamus or any other appropriate writ(s) to the respondents 1st set against the respondents- 2nd set on the ground that the 2nd set are judgment debtors and antisocial elements who had created disturbances four times

Patna High Court CWJC No.1612 of 2023(2) dt.18-03-2023 2/2 in compliance to the orders dated 07.06.2009, 08.08.2009 and 22.09.2010, 11.09.2016 in Title Execution Case No. 05/2008 for the delivery of possession to the petitioner/ the judgment holder who got the judgment order in Title Suit No. 52/06 on 16.9.2008 and decree on 26.02.2008 passed by the Learned Sub-judge-1st Benipur, Darbhanga but the members of the Respondents-2nd set evade the learned Execution Sub-judge-1st Benipur, Darbhanga and the petitioner is mercilessly being tortured by the henchmen of the judgment debtors. Secondly the learned Court below also be directed to conclude the case within 6 months so that the judgment decree holder can get justice forthwith." At the outset, the learned counsel for the petitioner submits that the petitioner would be approaching the Executing Court by filing appropriate petition for taking appropriate and needful action in the direction of executing the judgment and decree in question, hence the Executing Court be directed to consider the same and expedite the matter.

It is directed, accordingly.

The writ petition stands disposed off.
