The petitioner seeks regular bail in connection with Khagaria (Muffasil) P.S. Case No. 127 of 2018 registered for the offence punishable under Sections 363 and 366(A)/34 of the Indian Penal Code.
The allegation is regarding the accused persons including the petitioner having kidnapped the victim girl. The learned counsel for the petitioner by referring to the statement of the victim girl, made under Section 164 Cr.P.C. before the learned Magistrate, submits that the victim girl has stated that the co-accused person namely Mithlesh Kumar had taken her away and she had voluntarily gone with him and married him, hence it is apparent that the petitioner has no
Patna High Court Cr.Misc. No.3104 of 2019(2) dt.23-01-2019 2/2 complicity in the matter. It is further submitted that the said Mithlesh Kumar has been granted bail by this Court by an order dated 26.06.2018 passed in Criminal Misc. No. 34203 of 2018. Lastly, it is submitted that the petitioner has a clean antecedent and he is in custody since 06.12.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 127 of 2018.
