This is third attempt for grant of bail on behalf of the petitioner in connection with Chapra Muffassil P.S. Case No. 73 of 2013 registered for the offence under Section 376/34 of the Indian Penal Code.
On merit, earlier, prayer for bail of the petitioner was rejected. At the second time, report from the court below was called for, which was received, from which it transpired that trial had already commenced.
Learned counsel for the petitioner submits that out of 15 charge sheeted witnesses six witnesses have been examined, however, he tried to persuade the court that witnesses have not
Patna High Court Cr.Misc. No.19985 of 2015 (2) dt.13-05-2015 2/2 supported the prosecution case.
Be that as it may, since trial is going on, there is no need to review my earlier order.
The prayer for bail again stands rejected.
Keeping the fact that petitioner is in custody since 2013, while dismissing the present petition, it is desirable to observe that the learned trial court may take appropriate steps so that the trial may come to its logical end without unnecessary delay.
