JUSTICE SHIVAJI PANDEY ORAL ORDER 17-06-2015 Heard learned counsel for the petitioners and the State. In this case the petitioner is seeking bail in Ramnagar P.S. Case No. 253 of 2014 registered under Sections 379 and 411 of the Indian Penal Code.

As per the First Information Report, when the informant along with his staff, namely, Md. Shahid were sleeping in the industry, he woke up on some sound and saw that two thieves were taking away the cycle of Md. Aslam, the staff of the informant. Md. Shahid had chased and caught the two persons, namely, Azad Mian and Sarun Mian. From the possession of the petitioners, a cycle was recovered which the petitioner no. 1 claims to be his old cycle.

Petitioners are in custody since 17.11.2014.

No.19046 of 2015 (2) dt.17-06-2015 2 / 2 Considering the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Bagaha, West Champaran (Bettiah) in connection with Ramnagar P.S. Case No. 253 of 2014, subject to the conditions that :

(i) one of the bailors will be a close relative of the petitioners, (ii) if the petitioners would be found involved in similar type of case in future, prosecution will be at liberty to file application for cancellation of bail and the court below will pass necessary order, including the cancellation of bail bonds and (iii) that the petitioners would co-operate and if the petitioners will fail to co-operate in the proceeding of the court and will remain absent for two consecutive dates without reasonable explanation, the court will pass appropriate order, including cancellation of bail bonds.
