JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, some prosecution witnesses appear to have expressed their suspicion regarding the involvement of the petitioner in the present crime and after that petitioner and some co-accused were arrested and made their respective confessional statements. Petitioner does have criminal antecedent but it appears that except suspicion, criminal antecedent as well as confessional statements, there is nothing against him.

Patna High Court Cr.Misc. No.10942 of 2016 (2) dt.09-03-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sasaram, Rohtas in connection with Sasaram Nagar P.S. Case No. 714 of 2015.
