JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One country made loaded pistol and one live cartridge are said to have been recovered from conscious possession of the petitioner for which petitioner is in jail custody since 07.11.2015 but para-3 of the petition reveals that petitioner does carries criminal antecedent of several cases, therefore, I am not inclined to grant privilege of bail to the petitioner, hence his prayer for bail in connection with Banka ( Barahat) P.S.Case No. 675 of 2015, pending in the court of Chief Judicial Magistrate, Banka stands rejected.

However, learned trial court is directed to expedite the trial and try to conclude the same, preferably, within four months

Patna High Court Cr.Misc. No.10620 of 2016 (2) dt.08-03-2016 2/2 from the date of receipt/ production of copy of this order, failing which petitioner shall be at liberty to renew his prayer for bail before the learned trial court itself.
