The petitioners have filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code.

The allegation against petitioners and other coaccused persons is that they assaulted the informant by means of brick due to which he sustained head injuries.

Patna High Court CR. MISC. No.3880 of 2023(2) dt.03-04-2023 2/3 It is submitted by learned counsel for the petitioners that the petitioners are innocent and they have committed no offence. They have falsely been implicated in the present case. There is no specific allegation against the petitioners rather the allegation levelled against them are general and omnibus. It is also submitted that petitioners are languishing in judicial custody since 10.11.2022.

Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Samho P.S. Case No. 69 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount
