Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a),32(1),32(3),41(1)41(2) of Bihar Prohibition and Excise Amendment Act, 2016. Recovery of liquor is alleged from a Hut and allegation is that the petitioner was found running away from there, however apprehended thereat on suspicion. Petitioner is in custody since 31.10.2020. Investigation of the case is already complete.
Considering nature of allegation and completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of
Patna High Court CR. MISC. No.17795 of 2021(3) dt.21-10-2021 2/2 learned Court below where the case is pending in connection with Spl. Case No.6438 of 2020 arising out of Kankarbagh Police Station (P.R.) Case No.152 of 2020 with following conditions:
(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
