JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-01-2022 Heard Mr. Shyamal Prakash, learned Advocate for the petitioners and the learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Parwalpur P.S. Case No. 48 of 2020 dated 04.03.2020 instituted for the offences under Section 498(A) of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.
The petitioners are the parents-in-law of the informant. Though they have been arraigned as accused persons in this case, but the entire accusation is directed towards their son, who is the husband of the informant. Nonetheless the learned counsel for the petitioners submits that the petitioners in their capacity as parents-in-law of the informant would advise and
Patna High Court CR. MISC. No.15295 of 2021(2) dt.04-01-2022 2/2 coerce their son to negotiate with his wife for an effective and amicable settlement of matrimonial discord between them. The petitioners are ready to offer any assistance which would be expected of them as parentsin-law. Apart from this, it has been submitted that up till now, the petitioners have been impressing upon their son for resolving the matrimonial dispute with his wife. For the reasons aforestated, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Hilsa, Nalanda in connection with Parwalpur P.S. Case No. 48 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
