Petitioner is in jail custody since 2.1.2016 in a case registered under section 414 of the Indian Penal Code on the accusation that he along with one Harilal Mahto was caught with stolen motorcycle whereas FIR named accused Munna Mahto succeeded to escape from there. At the time of arrest, petitioner disclosed that the aforesaid motorcycle was stolen property and it was co-accused Munna Mahto who had stolen the said motorcycle. Furthermore, petitioner disclosed that he along with Munna Mahto and one other accused were going to sell the aforesaid motorcycle. .Petitioner does not have any criminal antecedent and it is submitted that co-accused Harilal Mahto has already been granted privilege of bail by the court below itself.
Patna High Court Cr.Misc.
