JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in connection with K.Hat (Maranga) P.S.Case No. 662 of 2015 registered under Sections 364(A)/34 of the Indian Penal Code.

The accusation is of kidnapping the minor son of the informant in course of returning from School on 15.10.2015. Thereafter demand of ransom from Mobile no. 9006557910 was made by unknown person and threatened to kill the husband of the informant in case of non payment of ransom.

Learned counsel appearing on behalf of the petitioner submits that , in fact, he is the Mousa of the victim and has falsely been implicated in the present case.

On the other hand, learned A.P.P. opposes the

Patna High Court Cr.Misc. No.9689 of 2016 (3) dt.28-04-2016 2/2 rpayer of bail and submits that the statement of the victim was recorded u/s 164 Cr.P.C. in which he has stated about the kidnapping by petitioner and one Prabhakar.

Having considered the facts and circumstances of the case, I am not inclined to grant bail to the petitioner and same is rejected.
