2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 324 and 34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added.

3. As per prosecution case, this petitioner, along with his maternal uncle, namely Ranjit Das, assaulted father of informant due to which he died during course of treatment.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has falsely been implicated in this case. Informant is not an eye witness of the occurrence. As a mater of fact, due to land dispute, some enemies assaulted father of informant and even as per F.I.R., it was this petitioner

Patna High Court CR. MISC. No.5351 of 2025(2) dt.07-03-2025 2/2 and his maternal uncle who took father of informant to the hospital but in course of treatment, he died after two months of the alleged occurrence. One co-accused, namely Ranjit Das, has already been acquitted by the learned trial court vide order dated 16.03.2024 passed in S.T. No. 103 of 2023 (Annexure-3 to this application). Charge-sheet has already been submitted and petitioner is in custody since 05.10.2024. Petitioner claims clean antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, nature of accusation, period of custody and clean antecedents of the petitioner, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of concerned trial court in connection with S. T. No. 103 of 2023 arising out of Pipra P.S. Case No. 120 of 2022. (Prabhat Kumar Singh, J) shashank/- U T
