JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-02-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of informant is languishing in custody since 14.12.2015 in a case registered for the offences punishable under sections 498A, 379 of the IPC and under section 3⁄4 of Dowry Prohibition Act.

The basic accusation is of torture for non fulfillment of dowry demand.

Learned counsel for the petitioner submits that petitioner admits the marriage with the informant and is still ready to keep her with full dignity and honour. Statement to that effect has been made in paragraph 14 of the petition, which reads thus:- "14. That the petitioner is ready to keep her as a legal wedded wife with full dignity and honour."

It is further submitted that petitioner has not performed

Patna High Court Cr.Misc. No.9776 of 2016 (2) dt.26-02-2016 2/2 second marriage. Statement to that effect has been made in paragraph 15 of the petition, which reads as follows:- "15.

The petitioner has never solemnized the second marriage with another girl." Considering the facts aforesaid, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Amrendra Kumar, learned Judicial Magistrate, 1st class, Jamui in connection with Laxmipur P.S. Case No. 116 of 2015.
