In course of investigation one co-accused Ganauri Ram was arrested and confessed his guilt giving detail of manner in which deceased was killed. Even if confessional statement of co-accused Ganauri Ram assumed to be true, then also, it is co-accused Ganauri Ram who gave fatal blow to deceased.

Moreover, co-accused Laukesh Ram @ Lavkesh Ram, against whom there is allegation that he took the victim from his house, has already been granted privilege of bail by a coordinate bench of this court.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Nabinagar P.S. Case no. 120/2014. shahid (Hemant Kumar Srivastava,J) U T
