By order dated 01.08.2022, time was granted to the petitioner for filing rejoinder affidavit. Again, on 08.09.2022, time was granted to the petitioner to file rejoinder. On 13.02.2024, by way of last indulgence, time was also granted for filing rejoinder. But, today, when the matter was called out, no body appears for the petitioner and as per the office note dated 26.02.2024, no rejoinder has been filed, as yet. 2.
Learned counsel for the Bihar State Food Corporation is present. She submits that out of total outstanding amount of Rs. 38,78,734/-, the petitioner paid only Rs. 12 lacs
Patna High Court CWJC No.3767 of 2020(7) dt.28-02-2024 2/2 to the B.S.F.C. in the year 2016 in two instalments, whereas the entire amount was to be paid in four instalments, within a period of one year.

Since no body is appearing for the petitioner for a long time, the present writ application stands dismissed on account of non-prosecution.
