JUSTICE MOHIT KUMAR SHAH ORAL JUDGMENT Date : 18-12-2018 Re: I.A. no. 7925 of 2018 The present interlocutory application has been filed for amending the main writ petition and now, the petitioner seeks to challenge the order dated 04.10.2016 passed by the Sub-Divisional Officer, Nemchak, Bathani, Gaya whereby and whereunder, the licence of the petitioner has been cancelled. I.A. no. 7925 of 2018 is allowed. The Registry is directed to add the prayer mentioned in paragraph no. 1 of the present interlocutory application as an additional prayer to paragraph no. 1 of the main writ petition.

Patna High Court CWJC No.4857 of 2017 dt.18-12-2018 2/2 assail the order dated 29.03.2017 passed by the Sub-Divisional Officer-cum-Licensing Authority, Neemchak, Bathani, Gaya by filing an appeal under Rule 32 of Bihar Targeted P.D.S. (Control) Order, 2016.
In view of the short submission of the learned counsel for the petitioner, the present writ petition is disposed of with liberty to the petitioner to file an appropriate appeal before the appellate authority against the aforesaid order dated 29.03.2017. It is further directed that in case, the petitioner files an appeal within a period of four weeks from today, the concerned appellate authority shall examined the case of the petitioner on merits without being impeded by the issue of limitation.
