The petitioner seeks pre-arrest bail in connection with Dumraon (Naya Bhojpur O.P.) P.S. Case No. 353 of 2018 registered under Sections 406 and 420 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that save and except the ocular allegation of handing over Rs. 11,000/- to the petitioner by the informant for the purpose of filing income tax return, there is no documentary evidence to support that any amount was given to him. He contended that the allegations made in the FIR are absolutely false and have been made in order to blackmail the petitioner and others and extract money.

Learned counsel for the State opposed the prayer for

Patna High Court Cr.Misc. No.2937 of 2019(2) dt.23-01-2019 2/2 grant of pre-arrest bail to the petitioner.

Considering the nature of allegation and the submissions made above, in the event of arrest or surrender before the court below, the petitioner, who is reported to be a man of clean antecedent, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Dumraon (Naya Bhojpur O.P.) P.S. Case No. 353 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md. S/SKSuman.
