Informant's motorcycle was stolen away by unknown thieves whereupon instant case has been launched. During course of investigation motorcycle was seized from the house of the petitioner as well as petitioner was also apprehended at that very moment.

From Annexure-2 search-cum-seizure list, it is apparent that there happens to be interpolation at the column no.2 the date relating to conduction of search and on account thereof, recovery in terms of disclosure made by the petitioner became doubtful. Petitioner happens to be under custody since 07.02.2015.

Accordingly, petitioner Bhola Sahni is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.17132 of 2015 (2) dt.30-04-2015 each, to the satisfaction of learned Sri A.K. Srivastava, Judicial Magistrate, 1st Class, Muzaffarpur in connection with Maniari P.S. Case No.27 of 2015.
