JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-03-2019 The petitioner apprehends his arrest in connection with Dhansoin P.S.Case No. 92 of 2018 registered under Sections 147, 148, 149, 307, 323 and 341 of the Indian penal Code. Petitioner is named in the FIR along with 08 other accused persons and it is alleged that petitioner and others assaulted on the head of the informant and they did not allow to come at the Darbaja of Motilal and there is specific allegation against this petitioner is that he has assaulted by lathi on the head of the husband of the informant causing injury to him. Submission of learned counsel for the petitioner is that there is case and counter case in between the parties and furthermore in their statements the witnesses have disclosed that there was scuffle between the parties with respect to some dispute and they have not named any person specifically.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar in connection with Dhansoin P.S. Case No. 92 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
