1. Heard the parties.

2. The petitioners apprehend their arrest in connection with Pranpur P.S. Case No. 61 of 2024 dated 22.04.2024 registered under Sections 341 / 323 / 307 / 379 / 504 / 506 / 34 of the I.P.C.

3. The prosecution case as per the first information report is that on 21.04.2024 the informant was surrounded by the petitioners and other accused persons and assaulted by fists and slaps. The co-accused / Indrajit Yadav assaulted the informant by means of butt of the pistol on his head.

4. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the present case due

Patna High Court CR. MISC. No.3827 of 2025(3) dt.06-02-2025 2/3 to land dispute between the informant and his own brother Husain Alam @ Husne Alam (petitioner no. 2). He next submits that the informant is a political person and at present he is Sarpanch of Bairia Panchayat and all the cases have been lodged by the informant and / or at the instance of the informant. He further submits that injuries caused to the informant is simple in nature. A compromise petition between the parties has been filed before the court of J.M. 1st Class, Katihar. Similarly situated coaccused / Md. Ashraf @ Ashraf Alam, Indrajeet Yadav and Sugwa Yadav @ Sukhwa Yadav @ Kishan Yadav have been granted anticipatory bail vide Cr. Misc. No. 76953 of 2024.

Regard being had to the submission made by the parties, taking into consideration the fact that own brother of the informant is accused in the present case having previous enmity, injuries caused to the informant is simple in nature and similarly situated co-accused have been granted anticipatory bail by this court, I am inclined to grant anticipatory bail to the petitioners.

6. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of
