No clear or tangible threat has been made out by the petitioner so as to necessitate exercise of jurisdiction under article 226 of the Constitution of India.
Mere apprehension has been expressed that he is likely to be removed or terminated from the post of Block teacher.
Counsel for the petitioner makes submission that his appointment has been put to question in the proceeding arising out of CWJC No. 18611 of 2016 wherein he has been
Patna High Court CWJC No.5715 of 2017(2) dt.04-12-2018 2/2 impleaded as a respondent.
This Court would only observe that if there is any threat to the petitioner in the proceeding arising out of CWJC No. 18611 of 2016 it is for him to appear in that proceedings and defend his appointment.
No order is required to be passed in the instant proceeding as the writ petition is premature. The writ petition is dismissed.
