JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Although the case was initially, registered under Section-363 of the Indian Penal Code in respect of so-called kidnapping of one Muralidhar Krishna and subsequently, the case was converted u/S 364A of the Indian Penal Code but in course of investigation, it came to light that the aforesaid so-called Murlidhar Krishna has hatched up a conspiracy of his kidnapping for demanding money from his father and the petitioner is one of his associates. The petitioner is languishing in jail custody since 08-12-2016 and even if, the findings, arrived at by the I.O. after investigation, assumed to be true, then also, at best, it is a case of Section-420 of the Indian Penal Code.

Accordingly, petitioner named above, is directed to be

Patna High Court Cr.Misc. No.12152 of 2016 (2) dt.30-03-2016 2/2 released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Siwan Town P.S. Case No. 651 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Siwan.
