2. The present writ petition has been filed for following reliefs:

(i). For issuance of writ in the nature of Mandamus directing and commanding the respondents to pay the compensation to the petitioner against his Khatiani Raiyati land measuring 21 1⁄4 decimal of land of old Khata No. 114, New Khata No. 287, Old Plot No. 2068, New Plot No. 3241 situated at Mauza- Kamtol, Thana No. 112, Anchal- Morwa, District- Samastipur, by which land of the petitioner out of his total Khatiani/ Raiyati land measuring 4 Bigha, 10 Katha, 10 Dhur of the said plot, the Pucca Road has been constructed by the Authorities of the State of Bihar,

Patna High Court CWJC No.1145 of 2022(6) dt.23-07-2026 2/3 the concerned Respondents under Pradhan Mantri Gram Sarak Yojana without initiating any Land Acquisition proceeding and or without acquiring the Raiyati land of the petitioner and or without making payment of compensation as provided in law of the land under the provisions of land acquisition Act. (ii). To Direct the Respondents to pay the compensation in compliance of the order dated 11.10.2019 passed by Sri Rajeev Ranjan Sinha, District Public Grievance Redressal, Samastipur in the complaint Case No. 419110123071902926 dated 23.7.2019, as well as the order dated 12.2.2021 passed by the Commissioner Darbhanga Division Cum 1st Appellate court in Appeal Case No. 419110123071902926/1A filed by petitioner, by which the commissioner Darbhanga Division has confirmed the order passed District Public Grievance Redressal, Samastipur.

(iii). For issuance of any other writ/ writs, order/ orders, direction/ directions as your Lordships may deem fit and proper.

3. It is specific submission of the petitioner that in spite of repeated requests from the Authorities concerned no compensation amount has been paid to the petitioner in respect of the land used by Pradhan Mantri Gram Sarak Yojana.

Learned counsel for the State drawn attention of the Court towards paragraph no. 9 of the counter-affidavit filed on behalf of the respondent no. 3, which indicates the fact that petitioner is entitled to compensation amount but compensation amount has not been determined because the report of the Circle Officer, Morwa, District- Samastipur has not been provided till

5. Having heard the parties and considering the facts and circumstances of the case, I am of the considered view that the District Collector, Samastipur should look into the matter and shall direct the Authorities concerned to pay the residuary compensation of the petitioner within a period of four weeks.

6. With the aforesaid observation, the present writ application stands disposed of.
