JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner No. 1 is father-in-law whereas; petitioner No. 2 is cousin father-in-law of the deceased. According to prosecution case itself, the marriage of the deceased took place five years ago and she spent her married life in her matrimonial home for near about five years. The dead body of the deceased could not be recovered and as per submission of learned counsel for the petitioners, the dead body of the deceased was cremated after her death.

Further contention on behalf of petitioners is that the

Patna High Court Cr.Misc. No.10186 of 2016 (2) dt.03-03-2016 deceased died of her ailment and when the aforesaid fact came to the notice of informant, he filed a petition before the court below. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Saraiya P.S. Case No. 328 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, West, Muzaffarpur.
