JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Informant is not an eye witness of the alleged occurrence as it is admitted by the informant himself in the first information report and he doubted his suspicion against the petitioner and several other F.I.R. named accused persons on the basis of previous enmity and other matters. No doubt, petitioner is named in the first information report but no specific overt-act has been attributed against him and it is the case of the informant that some unknown criminals committed the murder of the deceased. So far as petitioner is concerned it is alleged that donation was collected by the villagers including the petitioner for committing
Patna High Court Cr.Misc. No.10328 of 2016 (2) dt.03-03-2016 2/2 the murder of the deceased and after that some shooters were hired who were paid by the villagers and other F.I.R. named accused persons.
Considering the aforesaid facts and circumstances as well as submissions of the parties, particularly, keeping in mind that only suspicion has been raised against the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Samastipur in connection with Samastipur Muffasil P.S. Case No. 15 of 2016.
