1. Heard Mr. Arvind Kumar Pradhan, learned counsel for the petitioners and Mr. Surendra Kumar, learned APP for the State.

2. The petitioners seek regular bail in connection with Mehandiganj P.S. Case No. 69 of 2024 dated 20.05.2024 registered for the offence(s) punishable under Sections 341, 323, 307, 504, 506/34 of the IPC and Section 27 of Arms Act.

3. As per the prosecution story, on 20.05.2024 at about 10:30 A.M., petitioners and others came at the house of the informant and started abusing and then co-accused Sonu Kumar took out a pistol and fired three times at the son of the

4. Heard both the sides and perused the FIR.

5. In the facts and circumstances of this case and considering the averments made in the petition and mainly petitioners' the pleas that both the parties are neighbour living in the same village and against the petitioners there is simple allegation of abusing and the main allegation of firing is against co-accused Santosh Kumar @ Golu who happens to be the brother of both the petitioners and also coupled with the petitioners' fair and clean antecedent and their custody period as well as completion of investigation against them, this court is inclined to grant the relief of regular bail. Accordingly, let the petitioners named-above be enlarged on bail in connection with Mehandiganj P.S. Case No. 69 of 2024 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned with following conditions:-

(1) Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the trial court and shall remain physically present as directed by the trial court and on their absence on two consecutive dates without sufficient reason, their bail bond shall be cancelled by the Court below.

(2) If the petitioners tamper with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of

(3) One of the bailors shall be a close relative of the petitioners who has sworn affidavit in this miscellaneous petition.

(4) The trial court will verify the criminal antecedent of the petitioners but acceptance of bail bonds will not be delayed on account of process of verification of the said criminal antecedent. If any criminal antecedent of any of the petitioners is found then the Court below shall take strict action against him for cancellation of his bail bond.
