The petitioner seeks bail in a case registered for the offence punishable under Section 306 of the Indian Penal Code.
The allegation is that due to quarrel with the petitioner, the deceased poured kerosene oil and set fire on her person and during treatment she died.
It is submitted on behalf of the petitioner that petitioner is the mother-in-law of the deceased. The deceased has been living for the last about ten years in her matrimonial house and out of wedlock, one son aged about 9 years was born. This case has been filed due to ill-information, which has been realized by the informant and he has filed affidavit in the court of C.J.M., Begusarai, wherein it has been stated that after lodging the case he came to know that there was good relationship between the deceased and the petitioner. During cooking the Dibia(lamp) fell down on her person
Patna High Court Cr.Misc. No.21565 of 2015 (2) dt.04-06-2015 2 / 2 which caused burn injury and she died during her treatment. The petitioner has no criminal antecedent. Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in Barauni ( Chakiya O.P.) P.S. Case No. 198 of 2014 with the following conditions :
1. One of the bailors will be the close relative of the petitioner.
2. The petitioner will not indulge in similar or in any other offence.
3. The petitioner will be well represented in the court.
4. In case of absence for two consecutive dates or in violation of the terms of the bail, her bail bond will be liable to be cancelled by the court concerned.
