JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-02-2016 Petitioner being father-in-law of the informant is languishing in custody since 04.12.2015 in a case registered for the offences punishable under Sections 498A, 323, 307, 506, 504, 34 of the Indian Penal Code.
The prosecution case is of inflicting torture for non-fulfilment of dowry demand of Rs. 50,000/- and causing sharp cut injury on the neck of the informant. It is submitted by learned counsel for the petitioner that accusation of causing injury to the informant is against petitioner, his wife and daughter but only one sharp cut injury has been found on the neck, simple in nature. For the occurrence of 01.12.2014 the F.I.R was registered on 03.12.2015. On conclusion of the investigation, final form was submitted under Sections 498A, 323, 504/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

No.10015 of 2016 (2) dt.29-02-2016 2/2 Considering the fact that accusation has not been found true under Section 307 I.P.C, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Danapur, Patna in connection with Naubatpur P.S. Case No. 696 of 2015.
