JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 The petitioner seeks regular bail in connection with Turkauliya P.S. Case No. 578 of 2019, registered for offences punishable under Sections 147, 148, 149, 341 and 302 of the Indian Penal Code.

Prosecution case is that petitioner and other accused persons came variously armed to the house of informant and it is alleged that on the order of co-accused Bipin Yadav and Arvind Yadav, co-accused Lalbabu Yadav fired on the father of informant on his head and thereafter, other co-accused persons, namely, Dilip Kumar Yadav and Arun Yadav also fired on the informant on his head, causing his death. Petitioner is also named in the F.I.R.

It has been submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.2023 of 2020(3) dt.25-02-2020 2/2 from the F.I.R., itself it is evident that no specific allegation has been attributed to the petitioner and he has been in judicial custody since 21.10.2019.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Turkauliya P.S. Case No. 578 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
