JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-03-2016 This is an application for bail in a case of misuse. Initially the case was registered under Sections 47(a) of the Excise Act and 20(1) of the NDPS Act when the petitioner was granted bail on 06.12.1997 and the matter was fixed for evidence on 17.03.1999 when the petitioner did not appear and his bail bonds were cancelled. Now the petitioner is in custody since 30.10.2015. It is submitted by learned counsel for the petitioner that the petitioner had no knowledge about the commencement of the trial. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that now the petitioner will regularly appear before the trial court. Considering the aforesaid facts, let the above named petitioner, be released on bail, on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.11289 of 2016 (2) dt.08-03-2016 2/2 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-1st-cum-Special Judge, (NDPS Act) Gaya in connection with N.D.P.S. Case No. 02 of 2002 arising out of Gaya Rail P.S. Case No. 88 of 1996. One of the bailors will be the family member of the petitioner. Learned court below will positively cancel the bail bonds of the petitioner if he defaults for two consecutive occasions.
