Heard the learned counsel for the petitioner and the State.

The instant writ petition has been filed by the petitioner for direction to the respondents to grant license for wood based industries for use up to 24" diameter wood including saw pit under the provisions of Bihar Wood Based Industries (Establishment and Regulation) Rules, 2017 and also for direction to the respondents to dispose off the application filed by the

Patna High Court CWJC No.4402 of 2019 dt.10-04-2019 2/3 petitioner in prescribed format along with demand draft of Rs. 11,000/- for grant of license of wood based industries, which has been kept pending in the office of respondent no. 2 from the month of January 2018.

Learned counsel for the petitioner has submitted that petitioner is manufacturing wood product under the Udyog Adhar Registration Certificate bearing No. BR36A0011545 in the name and style of "M/s Priyanka Cash Adharit Udyog". Petitioner has filed application in prescribed format along with relevant documents for the grant of license for the Wood Based Industries, Saw Pit and for use of up to 24" diameter wood, in the month of January, 2018.

Petitioner is presently using the wood of 18" diameter for manufacturing the wood product. The respondents always gave him threat that he has used more than 18" diameter wood for the manufacturing of the wood products.

It is further submitted that petitioner has filed application form for the use of up to 24" diameter wood under the provisions of Bihar Wood Based Industries (Establishment and Regulation) Rules, 2017 on 01.02.2018. The petitioner has filed several representations before the concerned authority for grant of

Patna High Court CWJC No.4402 of 2019 dt.10-04-2019 3/3 license. Copy of aforesaid representations dated 26.07.2018 and 04.10.2018 is annexed as Annexure-4.

Learned counsel for the petitioner has submitted that several times petitioner visited the office of the respondents but no order has been passed.

In such circumstances, this writ petition is disposed off with direction to Respondent no. 2 to pass appropriate order in accordance with law on the application filed by the petitioner for grant of license as contained in Annexure-1, which is still pending, after giving proper opportunity of hearing to the petitioner and looking into all the relevant documents, within a period of three months from the date of receipt/production of this order.
