====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 19-02-2025 Heard Mr. Shailesh Kumar, learned counsel appearing on behalf of the petitioners and Mr. Binod Kumar, learned APP for the State.

2. The petitioners seek pre-arrest bail in connection with Bihta P.S. Case No. 463 of 2023 registered for the offences punishable under Sections 328, 302 and 120(B) of the Indian Penal Code.

3. Considering the nature of allegation against the petitioners which relates to commission of alleged murder of the husband of the informant, I am not inclined to enlarge the petitioners on pre-arrest bail.

4. The petitioners, if so advised, may surrender before

Patna High Court CR. MISC. No.3763 of 2025(2) dt.19-02-2025 2/2 the learned District Court and seek regular bail. Learned District Court is directed to pass order on the same day on the basis of material available on records, as well as, collected in course of investigation.

5. Learned counsel seeks compassion on behalf of petitioner no.2 on the ground that he is 100% blind. If the said information is correct, same is required to be verified at the time of hearing of the regular bail on behalf of the petitioner no.2 by the learned District Court and pass a reasoned order in accordance with law taking into consideration the provision of the Rights of Persons with Disabilities Act, 2016, if any concession is required.
