JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-06-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State.

In a case under Section 304B of the Indian Penal Code, the petitioners have been made accused and seek

anticipatory through these applications.

Petitioners of Cr. Misc. No. 18993 of 2015 are father-in-law and mother-in-law of the deceased, whereas the petitioner of Cr. Misc. No.20736 of 2015 is the husband. As regards the husband, there is allegation that he had demanded the golden chain in the year 2010. Though there is allegation that subsequently, the husband of the petitioner was allegedly making demand of a motorcycle, It is submitted on his behalf that there is no allegation that such demand was made immediately before the death of the deceased, Rina Devi.

Learned counsel for the petitioners has further submitted, referring to Annexure-2 to these applications, which is a petition filed by the informant himself that, as a matter of fact, the informant was misled to institute the First Information Report.

In view of the submission as above and in view of the facts and circumstances of the case, let petitioners above named in the event of their arrest/surrender within four weeks from today in the court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction

of the learned Chief Judicial Magistrate, Bikramganj, Rohtas in Karakat P.S. case no. 161 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. This will be subject to condition that petitioners shall cooperate with the police in course of investigation and they shall present themselves before the Court below as and when required, failing which the prosecution shall be at liberty to approach this Court for cancellation of bail granted to them by virtue of the present order.
