The petitioner apprehends arrest in a case registered for the offence punishable under sections 302/120B of the Indian Penal Code and section 27 of the Arms Act. FIR is against unknown for murder of father of the informant.

Learned counsel for the petitioner submits that the FIR is against unknown and petitioner's name has figured during course of investigation in confessional statement of coaccused and except the same no other tangible evidence has been collected during course of investigation to suggest the implication of this petitioner in the present case.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Siwan in Siswan Police Station Case No. 59 f 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
