Petitioner is in jail custody since 19.12.2015 in a case registered under sections 25 (I-B) a, 26, 27, 35 of the Arms Act. The name of the petitioner came in this case in the statement of co-accused Basuki Thakur from whose possession country made rifle was recovered. The aforesaid co-accused Basuki Thakur has already been granted privilege of bail by a coordinate bench of this court which is evident from perusal of the impugned order itself. Considering the aforesaid facts and circumstances as well as this aspect of the matter that neither the petitioner was caught on the spot nor anything was recovered from his conscious possession, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Bhagalpur in Pirpainti P.S. Case no.
