JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 419, 420, 385, 387/34 of the Indian Penal Code.

Petitioner is said to have been caught by the informant when he had gone to collect extortion money but submission on behalf of the petitioner is that even if the prosecution story assumed to be true, then also, petitioner had gone to collect the money at the direction of one Vipul Pandey and the aforesaid fact was disclosed by the petitioner at the time of his arrest. Moreover, petitioner does not have any criminal antecedent

Patna High Court Cr.Misc. No.10676 of 2016 (2) dt.08-03-2016 2/2 and is languishing in jail custody since long. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur, Bhabua in connection with Bhabua P.S. Case No. 724 of 2015.
