JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 11-01-2022 Heard both the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Bahera P.S. Case No.324 of 2020 instituted for the offences under Sections 363/366(A) of the Indian Penal Code.

Taking into consideration the statement of the prosecutrix, in which, she has specifically stated that she has gone with her own sweet will and she is of 17 years of age, the petitioner, therefore, cannot be said to have abducted her. I view thereto, I am inclined to grant anticipatory bail to the petitioner and in the event of arrest, he shall be released on bail subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
