The petitioner is languishing in custody since 23.12.2014 in a case registered for the offences punishable under Sections 392 of the Indian Penal Code and 25(1-B)a/26/35 of the Arms Act.

It is alleged that the accused persons robbed the informant's cash and mobile. The petitioner was identified by the informant. On chase one Ratan singh was apprehended from whom one pistol, one cartridge, mobile and motorcycle were recovered.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.19376 of 2015 (02) dt.25-06-2015 2/2 petitioner that nothing has been recovered from the possession of the petitioner and the informant subsequently retracted from the accusation with regard to the petitioner.

Considering the fact that the investigation has already concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Saharsa in connection with Sonbarsa P.S. Case No. 107 of 2014.
