JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2017 The petitioner is apprehending his arrest in connection with Mahila P.S. Case No. 89 of 2016, registered for offences punishable under Sections 323, 498(A), 494, 504, 506/34 Indian Penal Code.
It has been submitted on behalf of the petitioner that in para -11 of the petitioner, he has already mentioned that he is ready to keep the opposite party No. 2- informant, with full honour and dignity and if opposite party No. 2 is also willing to live with him, he will withdraw his Divorce Suit No. 177 of 2016, filed before the Principal Judge, Family Court, Darbhanga. Heard learned A.P.P. as well as learned counsel for the informant. Learned counsel for the informant has submitted that
Patna High Court Cr.Misc. No.6193 of 2017 (3) dt.03-04-2017 2/3 opposite party no. 2 is also ready to live with the petitioner, if she is allowed to live with full dignity and care and has no objection, if the petitioner is released on provisional bail with condition that he will withdraw the above stated divorce suit. In view of the submissions of learned counsel for the parties that they are ready to live with each other, let petitioner surrender before the Court below on 18.04.2017, on which date, opposite party no.
2 shall also remain present and the court below shall watch the conduct of the petitioner and if it is found that he is ready to keep his wife with full honour and dignity, shall enlarge the petitioner on provisional bail to his satisfaction for a period of six months, during which period the petitioner and the informant-opposite party no.
Patna High Court Cr.Misc. No.6193 of 2017 (3) dt.03-04-2017 3/3 fit and proper.
Let no coercive steps be taken against the petitioner in connection with above mentioned case till 18.04.2017. With the above observation, this application is disposed of.
