The petitioner seeks bail in connection with Gaighat P.S. Case No.137 of 2023 registered for the offence punishable under Sections 302/120-B/34 of the Indian Penal Code.

The petitioner is said to have indulged in hatching conspiracy to kill the son of the informant in connivance with other accused persons.

Learned counsel for the petitioner has drawn the attention of this Court to the orders dated 31.08.2023 and 12.10.2023 passed in Criminal Miscellaneous Nos.55888 of 2023 and 65206 of 2023, by which similarly situated co-accused Rani Devi, Rohit Mandal @ Rohit Kumar and Mithilesh Sehani

Patna High Court CR. MISC. No.5814 of 2024(2) dt.17-02-2024 2/2 have been granted bail by a co-ordinate Bench of this Court. The petitioner is in custody since 25.11.2023 and he has clean antecedent.

Considering the fact that similarly situated co-accused persons have been granted bail by a coordinate Bench of this Court and also the fact that the petitioner has clean antecedent, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Court No.2, Muzaffarpur/ concerned Court, in connection with Gaighat P.S. Case No.137 of 2023.
