The petitioner is not named in the FIR in a case registered under Section 395 and 397 of the Indian Penal Code. From the house of the petitioner one Bala, an ornament is said to have been recovered.

It is submitted that for the recovery of that ornament Paraiya P.S. case No. 91/12 was registered under section 414 of the IPC and different sections of the Arms Act. The petitioner has already been enlarged on bail on that case. The petitioner was not put on T. I. parade and he is in custody since 11.08.2014. The petitioner has now remained in custody for about 11 months. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner

Patna High Court Cr.Misc. No.20124 of 2015 (3) dt.03-07-2015 2/2 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Paraiya P.S. Case No. 90/12.
