The petitioner seeks bail in connection with Dumraon P.S. Case No. 72 of 2014 registered for the offences punishable under sections 25(1-B)(a), 26 and 35 of the Arms Act. The prayer for bail of the petitioner was earlier rejected by order dated 09.09.2014 passed in Cr.Misc. No. 29776 of 2014 with following observations :- "The Chief Judicial Magistrate, Buxar is directed to expedite the trial and conclude the same as early as possible and preferably within a period of six months from the date of receipt/production of a copy of this order, failing which the petitioner would be entitled to renew his prayer for bail."

It has been contended that till date, out of six

Patna High Court Cr.Misc. No.19902 of 2015 (2) dt.29-04-2015 2/2 witnesses, only two could be examined on behalf of the prosecution.

Regard being had to the observation made in the aforementioned order dated 9th September, 2014, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Buxar in connection with Dumraon P.S. Case No. 72 of 2014.
