2. The petitioner seeks bail in a case registered for the offence punishable under Section 20(b)(ii)(A)(B) of the N.D.P.S. Act.
3. As per prosecution case, 40 grams Ganja in 14 packets were recovered from house of this petitioner and coaccused Bhola Roy.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No incriminating article has been recovered from conscious possession of this petitioner and he has falsely been implicated in this case merely on suspicion. It is further submitted that co-
Patna High Court CR. MISC. No.7002 of 2025(2) dt.07-03-2025 2/2 accused Bhola Roy, who is having similar allegations, has already been granted bail by a Co-ordinate Bench of this Hon'ble Court vide order dated 14.07.2023 passed in Cr. Misc. No. 40615 of 2023. Charge-sheet has already been submitted and petitioner is in custody since 27.11.2024.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case, nature of accusation, claim based on parity and period of custody, the prayer for grant bail of to the petitioner is allowed.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Patna in connection with Jakkanpur P.S.
