2. The petitioner seeks bail in connection with Rail (Dehri) P.S. Case No. 01 of 2024 dated 31.08.2024, instituted for the offence punishable under Sections 143(5) of the Bhartiya Nyaya Sanhita, 2023 and under Section 79 of the J.J. Act.

3. The prosecution case, in short, is that on 30.08.2024, the informant with armed forces were on patrolling duty on Dehri on Sone railway station. They saw three minor children seated with a man (petitioner) in the waiting hall. On enquiry, the informant found that said children were being transported to Mumbai and petitioner was involved in child trafficking.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that petitioner was going to Mumbai for his private job and children were also going to Mumbai to meet their family members, who reside in Mumbai. Petitioner has been arrested along with three children who were about 16 years old. Lastly, it has been submitted that the petitioner is in custody since 31.08.2024 having no criminal antecedents and charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judicial Magistrate, Railway, Gaya in Rail (Dehri) P.S. Case No. 01 of 2024.
