2. The present application has been filed for modification of order dated 27.06.2018 passed in CWJC No. 11637 of 2018 by which the writ petition was dismissed due to non-compliance of the said order on 11.07.2018.

3. Learned counsel for the petitioner submitted that though the order was passed in his presence and the defects had

Patna High Court MJC No.4274 of 2018 dt.03-03-2021 2/2 to be removed within two weeks but due to circumstances on account of the petitioner not being well and residing at Delhi, the same could not be done. It was further submitted that as the matter stood dismissed, the defects could not be removed. However, it was submitted that the same shall be removed within two weeks from today.

4. Having considered the facts and circumstances of the case and taking into account the averments made in the pleadings, the application is allowed.

5. The time granted for removal of defects in CWJC No. 11637 of 2018 by order dated 27.06.2018 stands extended by a further period of two weeks from today.

6. It is made clear that if within two weeks from today, defects are not removed, the present application shall be deemed to have been dismissed and as a consequence CWJC No. 11637 of 2018 shall also stand dismissed without further reference to the Bench.
