====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-01-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard learned counsel for the petitioners as well as the learned APP for the State.

The petitioners apprehend their arrest in connection with Akbarpur P.S. Case No. 243 of 2020, registered for the offences punishable under Sections 302, 120(B), 34 of the Indian Penal Code.

The informant, Brajesh Singh lodged the FIR with allegation that the marriage of his daughter Riya Rani (deceased) was solemnized with co-accused Mantu Singh 8-9

On 15.5.2020, the informant got an information that the in-laws of his daughter have done her to death and they are going to cremate the dead body. The informant went the place of cremation where some persons whom he did not identify were preparing the pyre (chita). The informant noticed ligature mark on the neck of the dead body. He has mentioned that he came to know that the present petitioners who are father-in-law and mother-in-law of the deceased along with other named accused in the FIR have killed the deceased by strangulating.

Learned counsel for the petitioners has submitted that Paragraph-6 of the case diary contains the place of occurrence. Paragraph-6 of the case diary shows that the I.O. has mentioned that in the southern-eastern room of the house the deceased was found dead and the informant was apprised that the deceased strangulated herself to death by putting a knot of saree and fixing it to the fan.

Considering the above-mentioned facts and circumstances and also considering that petitioners are fatherin-law and mother-in-law of the deceased and there is no allegation in the FIR of dowry demand, let the petitioners be released on bail in the event of their arrest or surrender within

No.14404 of 2021(3) dt.12-01-2022 3/3 four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Akbarpur P.S. Case No. 243 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
