The petitioner is in custody since 19.12.2014 in connection with Mahnar P.S. Case No.293 of 2014, registered for the offence under Sections-302, 201 and 120B of I.P.C.
Learned counsel for the petitioner submits that the allegation against the petitioner is that he along with his son ManiKumar Rai had taken some money to the tune of Rs.75,000/- for purchasing a piece of land, the owner of which was one Sant Lal Singh. Learned counsel further submits that the said Sant Lal Singh has stated in paragraph-34 of the case diary that in fact there was no such transaction proposed between the
Patna High Court Cr.Misc. No.18784 of 2015 (3) dt.20-07-2015 2/2 parties and that he has no connection with the said Pujaru Rai, the petitioner in the present case. Learned counsel for the petitioner further submits that save and except suspicion, there is no other cogent material in the case diary so as to connect the petitioner with the offence at hand.
Considering the aforementioned submissions, the period of custody and also the fact that the petitioner has no criminal antecedent, let the petitioner named above be enlarged on bail upon furnishing the bail-bonds of Rs.10,000/- (ten thousand) along with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Vaishali, Hajipur, in connection with Mahnar P.S.
