The petitioner seeks regular bail in connection with Hajipur Sadar PS case no. 426 of 2018 registered for the offence punishable under Sections 394 of Indian Penal Code and 27 of Arms Act.

The allegation is regarding snatching of cash by unknown miscreants from the informant.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case which is clear from the fact that the petitioner has been remanded in the present case while he was arrested in one other case. It is further submitted that neither any recovery has been made from the conscious possession of the petitioner nor

Patna High Court Cr.Misc. No.3967 of 2019(2) dt.25-01-2019 2/2 any test identification parade has been conducted so as to connect the petitioner with the alleged occurrence. Lastly, it is submitted that the petitioner is languishing in custody since 24.09.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar PS case no. 426 of 2018.
