The petitioner seeks bail in connection with Parsa P.S. Case No. 364 of 2021 instituted for the offences under Sections 30(a), 36 and 41(i) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 18.10.2021, charge-sheet has been submitted in the case and has antecedent of two cases. Learned counsel for the petitioner submits that the allegation is of recovery of 2975.04 litres of liquor from a truck as detailed in the F.I.R.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name transpired during the course of investigation.

Patna High Court CR. MISC. No.4365 of 2022(2) dt.07-03-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional & Sessions Judge-cumSpecial Judge, Excise, Saran in connection with Parsa P.S. Case No. 364 of 2021.
