The petitioners seek regular bail in connection with Special (Excise) Case No. 602/ 2019 arising out of Sonbarsha Raj P.S. Case No. 201 of 2019 for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 36 liters of illicit liquor from motorcycle of the petitioners.

The learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in the present case. It is further submitted that the petitioners are having a clean antecedent and are languishing in custody since 07.12.2019.

No.3860 of 2020(2) dt.21-01-2020 2/2 Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioners coupled with the fact that the petitioners are having a clean antecedent, I deem it fit and proper to direct for release of the petitioners on regular bail.

Accordingly, the petitioners, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Saharsha in connection with Special (Excise) Case No. 602/ 2019 arising out of Sonbarsha Raj P.S.
